Feb 26th, 2013 - Letter to Sheriff

Subject:  The Oath of office, the requirement of Honor, and the value of a man’s word

As I sit down to write this I am reminded that we have been down this road before.  On April 19th, 1775 a band of patriots waited all night in a tavern for what they had been told by the ride of Paul Revere was the oncoming British Army.  These brave men meant to make a showing, to stand guard and remind the British that they were there and that they would not be tread over by the dishonorable and unfaithful service of  the British Crown.  The patriots whom waited all night numbered no more than eighty while the British Army regulars were numbered to seven hundred.   Captain John Parker stood his ground, not wanting to fight, nor really expecting it, but he stood his ground regardless, even saying, “Stand your ground; don’t fire unless fired upon, but if they mean to have a war, let it begin here.”
The British had been mandated to secure a stash of arms and powder they believed was located at Concord, and they had hoped that by the continuing disarming of the ‘rebels’ they could restore order and quell the mounting dishevel.
It did not work out that way.  Instead the British army demanded that the patriots disband and lay down their arms.  Then the shot happened, the most famous shot ever produced by this country that would be heard round the world.  No one knows whom laid the weapon steady and fired, but it, none the less occurred.  At the end, the British at Lexington Green killed 8 patriots.    The opening volley of our founding, lay on the graves of those eight men, whom chose to stand against an innumerable world foe, against a King.
One must then ask, of what grievance did the people of that time have against the King? Here are but a few:
  1. He has refused his Assent to Laws the most wholesome and necessary for the public Good.    The king required that the colonies give him their laws and then decided on their validity.  If he disagreed, they were not made into law.  In other words, there was no Consent of authority and mutual liberty.  In fact, this important grievance was, by Jefferson’s own admission, in relation to an attempt by the colonies to abolish slavery.  The king, of course refused.  We today, have a very similar grievance where the governments refuse to acknowledge or respect our inalienable rights, even though; we protest and argue in court to attempt to ensure them.  The continued notion is that the State runs the law and by doing, ensures that the courts have zero authority to protect and ensure the Constitution are no different than the Kings of old and simply ignore the Constitution.
  2. He has refused to pass other Laws for the accommodation of large districts of people, unless those people would relinquish the right of Representation in the Legislature, a right inestimable to them and formidable to tyrants only. 
  3. He has obstructed the Administration of Justice, by refusing his Assent to Laws for establishing Judiciary powers.
  4. He has erected a multitude of New Offices, and sent hither swarms of Officers to harrass our people, and eat out their substance. --  there are more than 1300 government agencies currently operating in the US, many of which who’s Constitutionality has never been tested.  The Federal Budget for 2012 was $3,803,000,000,000.  A multitude of Offices whom by taxation eat out our substance.
  5. He has kept among us, in times of peace, Standing Armies without the Consent of our legislatures.  – we are now in a state of perpetual war, in fact, many of us now believe that We the People will be the next targets, and labeled as terrorists.
  6. He has affected to render the Military independent of and superior to the Civil power. – Every violation of the 2nd amendment is captured right here in this grievance.  For as Jefferson said, “Tyranny is defined as that which the government keeps for itself, but makes illegal for the citizenry.”
  7. He has combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws; giving his Assent to their Acts of pretended Legislation:  -- We are dangerously close to having the United Nations define our laws.
  8. For Quartering large bodies of armed troops among us: -- there are a multitude of Government agencies that pick away at us for every possible action.  In New York, it is possible for a police officer to stop you and frisk you for no other reason than he feels like it.  This, I would assume also mean you Sheriff, unless it was obvious you were Law Enforcement and simply looked like the rest of us you would be subject to this clear violation of your rights.
  9. For depriving us in many cases, of the benefits of Trial by Jury: & For transporting us beyond Seas to be tried for pretended offences – every time a law is enacted  that is illegal (and worse, enforced), and un-Constitutional, these two grievances gain truth.  For is there a difference, between a made up crime and an illegal law?  No, semantically they might differ, but the result is the same, a free or innocent man is tried, convicted, and imprisoned for something the state has no authority to imprison him for.
  10. For taking away our Charters, abolishing our most valuable Laws, and altering fundamentally the Forms of our Governments:  -- Of this one, they are surely guilty, our modern governments.
  11. He is at this time transporting large Armies of foreign Mercenaries to compleat the works of death, desolation and tyranny, already begun with circumstances of Cruelty & perfidy scarcely paralleled in the most barbarous ages, and totally unworthy the Head of a civilized nation. – there are more than 1000 US bases around the world, we are in a continual state of war against all manner of men and ideals, to such an extent, that we do not even know whom the enemy is, just some vague notion called ‘terror’.    There is no definition of law to protect individuals from this label. There is no definition of law to stop Law Enforcement from making this assessment themselves.  It, by itself, means a clear violation of due-process and responsibility of the Constitution.
  12. He has constrained our fellow Citizens taken Captive on the high Seas to bear Arms against their Country, to become the executioners of their friends and Brethren, or to fall themselves by their Hands. – This one, my fellow patriots, especially law enforcement, you should be the most aware of.  Although it specifies ‘captive on the high seas’ one need not take to much of an intellectual leap to see that we now stand in a place where We the People are going to be leveled against other citizens.  Other citizens who took an oath to protect and serve and have been convinced that his enemy is Us.  We are not the enemy, but are brothers, believers in the prominence of the Constitution.   The opening shot, the volley of words leveled against the King in the Constitution of the United States begins as such:
We The People in order to form a more perfect union…
It all begins with We, that is, all of the free people, the Liberty of mankind and his natural rights.  There was no us v. them in the Constitution.  That notion has been created over the course of a hundred years and gained a boulders weight. Such large stones may be unmovable by single men, it can be chipped away at by the collective whole whom wish to remove it from our path to Liberty.

There are more grievances that our founding fathers made against the King of England and all of them, if you look at them by their meaning, can be seen as windows into what is occurring today.  For as they said in the Declaration of Independence:
In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.
Simply replace prince with government and we have the state of our Constitution today, left toothless and in some cases completely forgotten.
What say you then?
I, a free man, a citizen of the United States, a child of the Constitution and son of God, have taken the oath keeps oath (http://oathkeepers.org/oath/) to protect and defend the Constitution.  To, if it must come to this, lay down my life for Her words.
I ask, sirs, do you, would you, take the oath at Oathkeepers and declare that there are orders that you will not obey (http://oathkeepers.org/oath/2009/03/03/declaration-of-orders-we-will-not-obey/)?
  1. We will NOT obey any order to disarm the American people.
  2. We will NOT obey any order to conduct warrantless searches of the American people, their homes, vehicles, papers, or effects – such as warrantless house-to house searches for weapons or persons.
  3. We will NOT obey any order to detain American citizens as “unlawful enemy combatants” or to subject them to trial by military tribunal.
  4. We will NOT obey orders to impose martial law or a “state of emergency” on a state, or to enter with force into a state, without the express consent and invitation of that state’s legislature and governor.
  5. We will NOT obey orders to invade and subjugate any state that asserts its sovereignty and declares the national government to be in violation of the compact by which that state entered the Union.
  6. We will NOT obey any order to blockade American cities, thus turning them into giant concentration camps.
  7. We will NOT obey any order to force American citizens into any form of detention camps under any pretext.
  8. We will NOT obey orders to assist or support the use of any foreign troops on U.S. soil against the American people to “keep the peace” or to “maintain control” during any emergency, or under any other pretext. We will consider such use of foreign troops against our people to be an invasion and an act of war.
  9. We will NOT obey any orders to confiscate the property of the American people, including food and other essential supplies, under any emergency pretext whatsoever.
  10. We will NOT obey any orders which infringe on the right of the people to free speech, to peaceably assemble, and to petition their government for a redress of grievances.

Will you stand with Liberty?  For if you do, know that I would gladly be a deputy in your troops, a citizen militiaman, ready to defend and protect alongside my fellow man.  But if you wish instead to fight on the side of Tyranny and to oppress the people, know that we are here as a porcupine and all that come at us will be stung and we shall defend our Constitution and God given inalienable rights.    Admiral Isoroku Yamamoto said, “…a rifle behind every blade of grass.”  This has never been more true than today.  And those that come to steal our Liberty, to deprive us of our property, shall find it to be true.
I respectfully request a reply. Do you stand with us?  Are you willing to take the oath and your oath of protecting the Constitution into your very blood and make it more than words?  I, along with my brothers, lay this question to you and ask that you give us a reply by April 18th, 2013.  The day, 283 years earlier, that Paul Revere set out to warn a sleeping giant that a merciless tyrannical government was bearing down on them.
